New lawsuit against Apple claims racial discrimination
Another day, another lawsuit. Employees of Apple's Upper West Side store in New York City have filed a suit for discrimination. Plaintiffs Brian Johnston, 34, and Nile Charles, 25, have accused Apple of discrimination after an incident they claim occurred on Dec. 9, 2010, according to "AppleInsider" (http://www.appleinsider.com). Both Johnston and Charles went to the store at 1981 Broadway when the incident allegedly began with an Apple employee, said to be white and in his 50s. The lawsuit notes that Charles and Johnston, who are black, went to the Broadway Apple store wearing "baggy jeans and large sweaters with hoods" to purchase headphones. The plaintiffs say the Apple employee, told them they weren't welcome at the store because of their race, notes "AppleInsider." The lawsuit was filed earlier this year in February in New York Supreme Court. The filing came to light this month after the case was moved to U.S. District Court in the Southern District of New York.

New Mac Defender variant doesn't require a password
Earlier this month, Intego (http://www.intego.com), a Mac security specialist, discovered the Mac Defender fake antivirus, which targets Mac users via SEO poisoning attacks (web sites set up to take advantage of search engine optimization tricks to get malicious sites to appear at the top of search results). Since then, several variants have appeared: MacDefender, MacProtector and MacSecurity, all of which are the same application using different names. The goal of this fake antivirus software is to trick users into providing their credit card numbers to supposedly clean out infected files on their Macs. Intego says it's discovered a new variant of this malware that functions slightly differently. It comes in two parts. The first part is a downloader, a tool that, after installation, downloads a payload from a web server. iPhone coming to India on May 27
Two of India's telecommunication firms -- Bharti Airtel and Aircel --will start selling the iPhone 4 smartphones in the country from May 27, reports "The Wall Street Journal" (http://macte.ch/dc9CL). Aircel says it will offer the Apple smartphone under both post-paid and pre-paid subscription plans. Bharti Airtel says it will offer similar plans.

Apple laptops excel in Consumer Reports' ranking
Apple's laptops excelled in the latest Consumer Reports' laptop ratings (http://macte.ch/lJRkK). All models of the MacBook Pro, MacBook and MacBook Air received good to great scores. The latest 15-inch MacBook Pros led their division with 76 to 78 points (out of 100). The 17-inch models garnered 80 and 81 points, topping their category. The 13-inch MacBook Pro and MacBook rated 70 to 72 points. The MacBook Airs tallied 76 points. Consumer Reports dubbed the 11-inch MacBook Air as the best choice for mobility, and the 13-inch MacBook Air as the best for mobility without sacrificing performance. Apple's iPad 2 also fared well. In the tablet computer category, Consume Reports ranked Apple’s 32GB iPad 2 with 3G support in first place. The 32GB iPad with Wi-Fi came in second and the first generation, 32GB iPad with 3G came in third.

AT&T lawsuit talks of 'phantom' traffic
A lawsuit filed by an iPhone owner alleges that AT&T makes monitoring data usage more difficult by not only overbilling its customers for data transactions, but also charging for so-called "phantom" traffic -- actions the customer didn't initiate, reports "ABC News" (http://macte.ch/7uIRl). The lawsuit, filed by AT&T customer Patrick Hendricks in the Northern District of California and seeking class action status, accuses AT&T of breach of contract and fraud for systematically overcharging for data usage. "AT&T's billing system for iPhone and iPad data transactions is like a rigged gas pump that charges for a full gallon when it pumps only nine-tenths of a gallon into your car's tank," the complaint says, attempting to represent all U.S. AT&T customers with a limited data plan for Apple's iPhone or iPad. Apple tells how to deal with Mac Defender malware
Apple has posted an article (http://support.apple.com/kb/HT4650) on "how to avoid or remove Mac Defender malware." A recent phishing scam has targeted Mac users by redirecting them from legitimate websites to fake websites that tell them that their computer is infected with a virus. The user is then offered Mac Defender "anti-virus" software to solve the issue. 

This “anti-virus” software is malware (i.e. malicious software).  Its ultimate goal is to get the user's credit card information, which may be used for fraudulent purposes. The most common names for this malware are MacDefender, MacProtector and MacSecurity.  Apple says it will deliver a Mac OS X software update soon that will automatically find and remove Mac Defender malware and its known variants.  The update will also help protect users by providing an explicit warning if they download this malware.

Analyst offers three reasons why Apple's stock will go...
In a note to clients -- as reported by "Fortune" (http://macte.ch/M7940) -- Piper Jaffray offered three reasons why he says Apple's stock will soon go even higher: ° "Even if the multiple does not increase or goes down, we believe the stock will move higher based on positive earnings revisions. Apple currently trades at 10.8x our CY12 EPS of $30.78 including cash, 8.5x ex-cash. Assuming Apple does more than $48 in EPS in CY14 (25% EPS growth), at current levels the stock would trade at a 6.9x EPS including cash and 4.4x EPS excluding an estimated $120/share in cash. Recosoft ships ID2Office 1.0 plug-in for InDesign
Recosoft Corp. (http://www.recosoft.com) has released ID2Office, an InDesign plug-in to convert InDesign files to the Microsoft Office file formats. It converts the text, associated fonts and styles, paragraph structure, corresponding property information, frames linking information, tables, graphics and other InDesign object and document properties to the matching Microsoft Word/PowerPoint object and File properties. Data Rescue gets support for new file types
Prosoft Engineering has updated Data Rescue (http://www.prosoftengineering.com), the data rescue utility for Mac OS X, to version 3.2. The upgrade has support for many new file types, as well as improvements in overall functionality and results.   Data Rescue is a hard drive and file recovery software for the Mac. It works even when your hard drive fails to mount or boot. The software doesn't attempt any repairs to the drive it's scanning; it focuses on data recovery, not hard drive repair. You will need to save your recovered files to either an internal or external hard drive (USB or FireWire), removable media device (such as a Zip or MO) or a networked drive.
 There are two ways to run Data Rescue. You may run it from the Boot DVD or you may run it as an application, depending on your circumstances. Data Rescue costs US$99 for a personal use license and $249 for a professional use license. Version 3.2 is a free update for registered users.

Cheetah3D for Mac gets new Preferences window
Cheetah 3D (http://www.cheetah3d.com/) -- software for modeling, animating and rendering 3D objects -- has been updated to version 5.7. The upgrade adds a new preferences window, extends the hotkey handling, allows the customization of many user interface colors and improves the Collada exporter. The new transform tool now supports multi-object selections, a gadget mode to arbitrarily align the transform gadget and improved snapping tools for precise modeling. Version 5.6 also introduces post- and pre-rotations. The added support for many video codecs like H.264 or MPEG-4, plus many small workflow enhancements, rounds out the new features. Cheetah3D costs US$149 for a single user version; however, version 5.7 is a free update for all registered users of version 5.x and is a $69 for an upgrade from versions 1.x, 2.x, 3.x and 4.x. Logic has released version 9.1.4 of Logic Express. Apple says the update improves overall stability and addresses a number of minor issues. The update is recommended for all users of Logic Express 9. iHS iSuppli: iPad stings computer sales
Rising consumer interest in media tablets like Apple's iPad is beginning to take a toll on the global computer market, with shipments of desktops and notebooks in the first quarter of 2011 declining compared to the same period in 2010, according to new IHS iSuppli (http://www.isuppli.com) research. Worldwide computer shipments amounted to 81.3 million units in the first quarter of 2011, down 0.3% from 81.6 million during the first quarter of 2010, says the research group. Three out of the world’s top five computer makers suffered year-over-year declines in shipments during the quarter (but, interestingly, not Apple). Samsung must show cell phones to Apple in legal brouhaha
Samsung Electronics has been ordered to turn over five of its not-yet-released mobile phones to Apple, reports the "Courthouse News Service" (http://macte.ch/YxXXw). Sitting in Federal Court in San Jose, Judge Lucy Koh ruled that Apple deserves the quick production of cell phone samples three months earlier than usual in the litigation process, though she drew the line at requiring testimony from Samsung executives, the article adds. 
"Apple has demonstrated good cause for some, limited expedited discovery," Koh said. "While Apple has not yet filed a motion for preliminary injunction, courts have found that expedited discovery may be justified to allow a plaintiff to determine whether to seek an early injunction. Galaxy S smartphones from Samsung outsold Apple iPhones in Japan during the first quarter of 2011, which places Samsung in the ranks of the top four handset vendors of Japan for the first time, according to Strategy Analytics (http://www.strategyanalytics.com). DTP Tools has released Active Tables, a plug-in that turns Adobe InDesign into a spreadsheet editor. The plug-in allows users to insert formulas instead of final numbers, having the numbers re-calculated when the source data changes. Formulas can process text and conditions, such as adjust tax amount on the invoice automatically based on the customer location. Quark, Perseus Books Group partner for digital publishing

Quark and The Perseus Books Group have entered into an agreement to implement Quark’s dynamic publishing software for book production, with a target launch of early fall.

 Through its Constellation service, Perseus will use Quark’s dynamic publishing solution to simplify and automate the process of publishing books across formats. A core feature of the Quark solution is the ability to create a single-source document that can be delivered across multiple types of media. The original book file is created in an e-book compatible format that is ready for export to the Web, social media, and mobile devices without further conversion.

VidConvert 1.0.4 for Mac OS X gets Passthrough option
Independent software developer Reggie Ashworth has updated VidConvert, his video converter for Mac OS X, to version 1.0.4. The upgrade contains a new Passthrough option in the Advanced panel.

Apple buys patents from Freescale Semiconductor
Apple recently recorded the receipt of 200 patents and pending patent applications from the electronics company Freescale Semiconductor, reports "PatentlyO" (http://macte.ch/L8X4F), a patent law blog. Although not recorded until May 18, 2011, the assignment is dated April 11, 2011.  "PatentlyO" notes that the law doesn't require that patent assignments be recorded. However, the recordation of rights protects the assignee against others who may later claim rights under color of title. Apple defends iOS developers in Lodsys lawsuit
According to several sources -- including "Macworld" (http://www.macworld.com) and "The Loop" (http://www.loopinsight.com), Apple's legal department has come to the defense of iOS app developers with a letter to Lodsys regarding its patent dispute with app developers. File It Away 1.0 released for Mac OS X
TeachTech (http://teachtechcolorado.com/) has introduced File It Away 1.0 for Mac OS X (10.6.6 or later). It costs $1.99 and is available through the Mac App Store in the Utilities category. Providing a drag-and-drop interface, File It Away is an utility for keeping Mac files and folders filed away. You can drag files or folders to the File It Away icon, and you can choose to move or duplicate them. The icon for the utility is automatically placed in the Dock at purchase. iPhone 5 to have curved glass design?
The latest in the never ending rumors on the iPhone 5 may have a curved glass design. According to reports at "DigiTimes" (http://www.digitimes.com) and other sites, Apple is going to adopt a curved cover glass for its next generation model of the smartphone. The company has reportedly has purchased 200-300 glass cutting machines to be used by glass makers, according to unnamed sources in Taiwan. "DigiTimes" says there's no timetable yet for the volume production of iPhone 5 as Apple is currently still working with related suppliers including those involved in cover glass, glass cutting, lamination and touch sensors to improve yield rates. The next gen phone will arrive sometime between June and September, depending on which source you believe.

Foxconn fire not expected to have major impact on iPad 2...
The explosion and following fire breaking out at Foxconn's production base of iPad 2 in Chengdu City, western China, hasn't affected the assembly lines of the tablet computer, according to Taiwan-based Chinese-language newspaper "Commercial Times" -- as reported by "DigiTimes" (http://macte.ch/HR3Dm). The location of the explosion is used to house coating lines and store some chemical materials, "CT" reports. As many iPad supply chain players have been concerned about the impact of the accident, Foxconn has replied to them that production will continue as originally scheduled. However, Foxconn is expected to increase the proportion of total iPad 2 output at its production base in Shenzhen, southern China, adds "DigiTimes."

Apple retail stores get a revamp
On Sunday Apple on Sunday unveiled a new look to its global retail stores, celebrating the store's 10th anniversary. The update uses dedicated iPads by all its products as sales tools for comparison shopping and customer assistance. Also, there's a new in-store app on the iPad is there "to answer questions from customers and keep them in the store," says "USA Today" (http://macte.ch/IufIJ). The first stores sporting the revamped look and iPad "smart stations" opened Sunday morning in Sydney, Australia. He plans on camping out on the streets of London for the launch of the iPhone 5 (whenever that may be). As part of his marketing and PR experiment, he's following one rule: he can't spent any money on anything he's taking with him. Tumult releases HTML5 animation builder for Mac OS X
Tumult has released Hype (http://tumultco.com/hype), a HTML5 animation builder for Mac OS X. Animations and interactive content made with Hype work on desktops, smartphones and iPads with no coding required. Hype sports a keyframe-based animation system. It leverages a recording system to create effective motions and transition, according to the folks at Tumult. Hype is available from the Mac App Store for an introductory price of $29.99. It requires Mac OS X 10.6 or higher. Hype's scene editor is powered by WebKit (the engine behind Safari and Chrome). Users can invoke arbitrary JavaScript for flexibility and leverage Hype's own JavaScript application programming interface to manipulate the document. Exporting to HTML5 involves copying a few lines of HTML code into an existing document and moving a resources folder. Hype also supports publishing exported documents to Dropbox.
