ITC delays S3 Graphics vs. Apple case
Yesterday the ITC had a deadline in the investigation of S3 Graphics' complaint against Apple, but instead of a ruling, the U.S. trade agency and quasi-judicial authority announced that it pushed back the target date for its Commission determination by six days until Monday, Nov. 21. The Commission is the six-member decision-making body at the top of the ITC. Administrative Law Judges make preliminary decisions, but the Commission has the final say. What lends the case particular significance is that S3 Graphics is being acquired by HTC, so any headway it makes could give the Taiwanese handset maker leverage, "though I tend to doubt that the combined power of HTC and S3 Graphics is going to force Apple into a settlement anytime soon," Florien Mueller writes for "FOSS Patents" (http://macte.ch/YJF6O). Last week Advanced Micro Devices (AMD) failed to persuade a U.S. judge to halt a patent dispute S3 Graphics has against Apple at the U.S. International Trade Commission, according to a...

iPad 2, iPhone 4S top SodaHead holiday gift wish poll
Consumers have revealed their holiday gift wishes according to a poll conducted by SodaHead.com, an opinion based social community. And it's good news for Apple. As the tablet wars heat up and consumers are presented with dozens of iOS and Android-based options, the clear winner on consumer's holiday wish lists is the Apple iPad 2, as 65% of those wanting a tablet hope to receive the top-selling device on the market. The latest entrants in the tablet market from Amazon and Barnes & Noble have not yet made a significant impact, as only 24% of respondents are hoping to receive a Kindle Fire and 11% desire the recently announced Nook Tablet.   Even though the iPad 2 is leading the tablet pack, Apple's tablet is not the top overall tech choice for the holidays, as 39% of respondents hope to receive an iPhone 4S, compared to 31% hoping for an iPad 2.  The Amazon Kindle Fire is the tech item of choice for 17% of respondents and 13% are hoping that Santa brings Xbox Kinect down the...

Apple shipped 17 million iPhones in third quarter
Worldwide sales of mobile devices totaled 440.5 million units in the third quarter of 2011, up 5.6% from the same period last year, according to Gartner (http://www.gartner.com). Smartphone sales to end users reached 115 million units in the third quarter of 2011, up 42% from the third quarter of 2010, according to the research group. Sequentially, smartphone sales slowed to 7% growth from the second quarter of 2011 to the third quarter of 2011. Smartphone sales accounted for 26% of all mobile phone sales, growing only marginally from 25% in the previous quarter.

" Some consumers held off upgrading in the third quarter because they were waiting for promotions on other new high-end models that were launched in the run-up to the fourth quarter holiday season," says Roberta Cozza, principal research analyst at Gartner. "Other consumers were waiting for a rumored new iPhone and associated price cuts on older iPhone models; this affected U.S. sales particularly."

The device could be either a bigger MacBook Air or a thinner MacBook Pro. The new laptop is expected to appear as early as the second quarter of 2012, says "DigiTimes," quoting unnamed sources from the upstream supply chain. Analyst thinks Cook will initiate Apple dividend policy
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- analyst Brian Marshall with the International Strategy & Investment Group said his firm's surveys have indicated most investors don't think Apple will initiate a dividend policy in 2012. However, he believes new CEO Tim Cook will make an effort to optimize his company's capital structure and will, in fact, pay out a dividend. Marshall says Apple could "easily" implement a dividend yield of 250 base points, amounting to about US$2.40 per quarter. A dividend payout would reduce Apple's free cash flow by between 20% and 25%, he says. However, Marshall estimates that a dividend yield would bring in more than $4 billion in incremental investments.

iPhone 4S can be sold in Australia -- for now
Apple will be able to continue selling its iPhone 4S in Australia for at least four more months without being hindered by a court injunction, according to "AustralianIT" (http://macte.ch/U7Dhg). Samsung has agreed to alter its application for a temporary injunction banning the iPhone 4S from sale there to an expedited application for a final injunction, the article adds. Last week Australia Federal Court Justice Annabelle Bennett ruled that Apple must provide Samsung with its contracts with Australian mobile-phone carriers as Samsung demanded in a patent dispute with the iPhone maker. Apple needs to produce agreements it has with Vodafone Group Plc, SingTel Optus and Telstra. Should Apple fail to agree on an assertion in Samsung’s patent lawsuit that the carriers are contractually obliged to subsidize iPhone sales, she ordered. Samsung sued Apple in Australia, claiming the iPhone 3GS, iPhone 4 and iPad 2 infringe its patents and is seeking a ban on the sale of the devices in the...

Ubermask for Mac OS X now offers 64-bit support
Nova Media's UberMask (http://www.novamedia.de/index_e.html) for Mac OS X (10.6 and higher) has been updated to version 2.1.4. The upgrade offers full 64-bit support, introduces new introductionary screens, an improved user interface and minor bug fixes. UberMask hides files and folders with a keystroke from curious eyes and inadvertent discovery. Even Spotlight can't find the files hidden by UberMask. A special hotkey can be defined to hide all previously selected files and folders with one keystroke. Another hotkey can be used to hide or reveal single files and folders. UberMask runs invisible in the background so that the launch of the app isn't required to use the hotkeys. The app itself keeps track of all hidden files and is password protected to prevent unauthorized access to UberMask. Ubermask is available at the Mac App Store for US$11.99. Verison 2.1.4 is a free update for registered users.

In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Piper Jaffray analyst Gene Munster says Apple should sell as many as 5.3 million Macs over the holidays. Extrapolating from data from the NPD Group, Munster thinks Mac sales are up 19% year-over-year in October. As sales continue to pick up leading up to Christmas, he sees Apple selling between 5.1 million and 5.3 million Macs during the December quarter. Those numbers would represent year over year growth of between 23 percent and 28%, notes "AppleInsider." Munster estimates that Mac revenue will represent about 18% of Apple's overall revenue during the company's December quarter.

iTunes 10.5.1 with iTunes Match available
Apple has released iTunes 10.5.1 with, at long last, its iTunes Match feature. With iTunes Match, even songs you’ve imported from CDs can be stored in Apple's iCloud. And you can play them on any iPhone, iPad, iPod touch, Mac, or PC. According to Apple, here’s how it works: iTunes determines which songs in your collection are available in the iTunes Store. Any music with a match is automatically added to iCloud for you to listen to anytime, on any device. Since there are more than 20 million songs in the iTunes Store, chances are, your music is already in iCloud. And for the few songs that aren’t, iTunes has to upload only what it can’t match. Which is much faster than starting from scratch. Once your music is in iCloud, you can stream and store it to any of your devices. Even better, all the music iTunes matches plays back from iCloud at 256-Kbps AAC DRM-free quality -- even if your original copy was of lower quality. You can obtain iTunes 10.5.1 via the Software Updates component...

Apple may look internally for Ron Johnson's replacement
Finding the next person to head its gigantic retail operation with Ron Johnson leaving to run J. C. Penney, won't be easy for Apple. The hunt is on, but the next person for the job may already be at Apple, says "Bloomberg" (http://macte.ch/5h2PO). Johnson's replacement faces several challenges such as implementing an ambitious expansion strategy in China while maintaining the stores’ high standards and industry-leading revenue per square foot, the article adds. "It’s a relatively small pool of talent," Brenda Malloy -- a managing director who specializes in retail recruitment for Russell Reynolds Associates, an executive-search firm in New York -- tells "Bloomberg." Finding just the right person may be so challenging that Apple CEO Tim Cook may instead turn to someone within the company, says Neil Stern, a senior partner at McMillanDoolittle LLP, a retail consulting firm. Only 64 companies qualify as global retailers, meaning they have US$1 billion in sales and business on at least...

Adobe: Apple helping kill mobile Flash
In a blog post (http://macte.ch/aNf5T), Adobe Flash developer relations chief Mike Chambers has Apple's unchanging stance against Flash has reduced Flash's chances of becoming a widespread platform for in-browser mobile apps. Another major factor was the rise of HTML5 on which Adobe is now placing more emphasis, he adds. Last week Adobe announced plans to cease developing Flash for mobile browsers to concentrate on HTML5. "Our future work with Flash on mobile devices will be focused on enabling Flash developers to package native apps with Adobe AIR for all the major app stores," an in-house Adobe email says. "We will no longer adapt Flash Player for mobile devices to new browser, OS version or device configurations. Some of our source code licensees may opt to continue working on and releasing their own implementations. We will continue to support the current Android and PlayBook configurations with critical bug fixes and security updates." (Read more at http://www.zdnet.com/blog/...

Samsung won't seek iPhonen 4S injunction in Korea
Korea-based Samsung has decided not to seek an injunction against the sale of Apple's iPhone 4S in its domestic market, reports "The Chosunilbo" (http://macte.ch/7fqS9). The new iPhone went on sale in Korea on Nov. 11. Samsung had debated until the last moment whether to file the motion after making similar applications in France, Italy, Australia, and Japan, says "The Chosunilbo."

"We concluded that we should engage in legal battles with Apple only in the global market, but not in order to gain more market share in Korea," A senior Samsung executive told the publication.
