Apple has been the most valuable tech stock and the world's second most valuable company -- after ExxonMobil -- since it passed Microsoft last May.

Nielsen: iPhone leads smartphone race
The race for the lead in U.S. smartphone operating system (OS) consumer market share is tighter than it has ever been. According to November data from The Nielsen Company (http://www.nielsen.com), the popularity of the Android OS among those who purchased a smartphone in the last six months (40%) makes it the leading OS among recent acquirers. But despite its surge among recent acquirers, when it comes to overall consumer market share, Android OS (25.8%) is still behind Apple iOS (28.6%). RIM Blackberry’s position is less clear: Its share (26.1%) puts it within the margin of error of both Apple iOS and Android. In other words, RIM remains statistically tied with both Apple for first and Android for third, says The Nielsen Company. Apple’s clear lead over Android notwithstanding, this race might still be too close to call. Nielsen Company says this much is clear, however: all three smartphone OS leaders -- Apple iOS, RIM Blackberry and Android -- are benefitting from strong demand for...

Oregon school district gives iPod touches to all third graders
The Canby School District in Oregon has issued an iPod touch to every third-grader, reports "The Oregonian" (http://macte.ch/1EEpa). Since first implementing a pilot project at Philander Lee Elementary three years ago, the district has used about $250,000 in state and federal grant and rebate money to purchase the Apple gadgets. In addition, the parent-teacher association at Lee Elementary raised about USS$12,000 to buy 60 iPod touches for the school's fourth- and fifth-graders, and another parent organization pitched in about $15,000 for 30 iPads at Eccles Elementary School, says "The Oregonian." The choice of equipping third-graders first was intentional, according to Joseph Morelock, the district's technology coordinator. The third grade is the first to take state tests, and administrators are eager to help students pass math achievement standards that have recently been raised, he told "The Oregonian." In presentations, Morelock has shown that several classrooms using the iPod...

Verizon/iPhone domains being scooped up
PocketNow (http://macte.ch/nxxe2) reports that that Verizon Trademark Services LLC, the company that owns verizon.com and verizonwireless.com, now also owns iphoneonverizon.com and iphoneforverizon.com. The site's Evan Blass says the sites were once owned by Jim Benton of HolyShnikes.com. Other domains that Verizon and/or Apple would probably want, including "verizoniphone.com," seem to have already been snatched up by squatters with thousands of other registrations. Presumably they'll either be sold or populated with paid content once the handset is announced, Blass says.

Shades of Windows: an Android Trojan
By Greg Mills It was only a matter of time; now an Android Trojan has been identified in the wild. The new Trojan has been named "Geinimi." The trojan was first found in China and is very likely to spread. The trojan is specific to Android so iPhones and iPads are unaffected. The security firm Lookout posted a Security Alert that can be found at http://blog.mylookout.com/2010/12/geinimi_trojan/ . The malware was detected in games found in third party Android app stores in China.  The worm is sophisticated and gets into Android phones hidden in games downloaded over the Internet. Such games as Monkey Jump2, a baseball game and a sex position app are known to have been infected. The malware takes over the phone and hooks up to any of 10 remove servers. The remote servers can pump the phone for private information and compromise security. Lookout has posted a solution for those affected.   What this does is confirm the fact that the open source notion of Android has weaknesses that are...

Apple will release a Verizon iPhone "very soon, maybe by Valentine's Day," reports "Bloomberg Businessweek" (http://macte.ch/yKrsO). An additional 10 million will be current Verizon subscribers who upgrade from other devices, and the rest will come from other carriers.

Man punches teen who won't turn off his iPhone
A 68-year-old Idaho man named Russell Miller was arrested Tuesday night for punching a teenager who refused to turn off his iPhone on an airplane, reports the "Daily Mail" (http://macte.ch/yO5IS). Witnesses said a 15-year-old boy completely ignored the routine instructions for passengers to switch off cell phones and electronic items. Miller, was enraged by the teen’s rudeness and lashed out, says the "Daily Mail." ‘He punched him so hard there was a mark on the teen's arm. That gave us probable cause to believe the reports from the other passengers,’ said Lieutenant Kent Lipple, of Boise Police. After the fight, the pilot radioed the air traffic control tower in Boise and requested police officers to meet the plane when it landed late Tuesday night. Miller was charged with one count of misdemeanor battery and was booked into Ada County jail.

Ex-Apple Store worker claims discrimination for a nervous...
According to a suit filed in a U.S. District Court in the Northern District of Illinois, Nicole Sullivan, 22, began work at the SoHo Apple Store in 2008. In April of 2009, she took a leave of absence due to a nervous disorder, and sought the services of a psychiatrist. Sullivan was given disability leave through an independent company, and was reportedly assured by the third party that the details of her medical condition would not be released to Apple. However, when Sullivan returned to work in August of 2009 after she was cleared by a psychiatrist, she said it was "obvious" to her that the store's employees, and "especially" its human resources director, were aware of her medical condition, notes "AppleInsider" (http://www.appleinsider.com). In her four month leave, Sullivan's job was replaced, and she was reportedly told that she would remain in a "holding pattern" until proper work was found for her. The lawsuit says she applied for several jobs at the store, but was denied for...

France eyeing tablet tax for iPads, Slates
French legislators are considering imposing a tablet-tax that would affect all models with at least 40GB of internal storage, though Windows-based slates would be exempt. The proposal, reported by "Numerama" -- and translated by "SlashGear" (http://macte.ch/gJYKG) -- is part of French “private copy” taxation which imposes extra fees on digital media like blank CDs, DVDs and thumb-drives; it’s estimated it would add up to €12 ($16) to the cost of Apple’s top-spec iPad or Android tablets. However, because Windows is classed as a “full” OS rather than a mobile one like iOS or Android, it escapes the taxation.

Analyst: iTunes 10% the size of Netflix
Though it is half as old as Netflix, Apple's iTunes rental service is believed to be about one-tenth the size of the competing rental service, analyst Brian Marshall with Gleacher & Company has told clients in a note, as reported by "AppleInsider" (http://www.appleinsider.com). He thinks Apple sells about 475,000 rentals daily through iTunes, compared to the 5.1 million daily rentals seen by Netflix. Marshall estimates that the iTunes rental business for TV shows and movies is larger than sales of purchases. He estimates that rentals generate more than US$60 million in revenue per quarter, while purchases account for about $50 million. Netflix reported revenue of about $550 million in September. Apple says iTunes users are renting and purchasing over 400,000 TV episodes and more than 150,000 movies per day. Marshall thinks that about 90% of iTunes TV viewings are 99-cent rentals, while 75% of movie viewings are rentals with an average selling price of $2.99. Applying those...

Microsoft co-founder refiles lawsuit against Apple, others
Microsoft co-founder Paul Allen has re-filed his patent suit against Apple, Google and several other major tech companies, adding specific examples of the alleged infringement, reports "AppleInsider" (http://www.appleinsider.com). In August it was announced that Interval Licensing, a tech licensing company controlled by Allen was suing 11 companies, including Apple, for violating patents on “fundamental web technologies” developed by Interval Research, the now-defunct Silicon Valley lab that Allen created with Xerox PARC veteran David Liddle in the 1990s. In addition to Apple, Facebook, Office Depot, Yahoo, YouTube, Netflix and eBay were targeted. Not surprisingly, Microsoft wasn't on the list. A total of four Interval Research patents were cited in the complaint, which seeks unspecified monetary damages for alleged patent infringement. Allen’s firm called the patents at issue in the suit “fundamental to the ways that leading e-commerce and search companies operate today." However,...

Apple sued (again) over user tracking
The suit, filed in federal court in Northern California, seeks both monetary damages and a court order to stop the profiling. It's similar to another lawsuit (http://macte.ch/yTIvy) filed Dec. 23 in federal court in San Jose, California, on behalf of Jonathan Lalo of Los Angeles County, and seeks class-action status. Both lawsuits claim iPhones and iPads are encoded with identifying devices that allow advertising networks to track what applications users download, how frequently they’re used and for how long. The transmission of such data violates computer-fraud and privacy laws. The tracking is possible because Apple assigns a UDID (Unique Device Identifier) to each iPhone, iPod touch and iPad, and apps can access that number. Advertising companies figured out this number can be used for tracking, much like a cookie in a browser, says "Wired." If an app passes that number along to an advertiser, the advertising company can use it to build up a profile of the user, as well as keep...

Marvel Comics has announced that starting in February issues of their Ultimate Comics line key to the "Death of Spider-Man" event storyline will be available as a digital download the same day as they go on sale in comic shops, reports "CBR" (http://macte.ch/NAu1b). Sold through Marvel's comiXology-powered app for devices like the iPad and iPhones, the issues mark the first time "event comics" will be offered day-and-date online, though Marvel has been experimenting with high profile releases in this format including the recent "Invincible Iron Man" Annual and the "Ultimate Thor" mini series, the article adds. The issues of "Death of Spider-Man" will be sold online at the same price point the in store issues have: US$3.99.

Here are the two job descriptions: "Apple is hiring outstanding operations engineers to deliver and manage the next generation of hosted infrastructure serving Apple products and devices. "Apple is hiring experienced software engineers to work on distributed computing for data with non-trivial properties, and efficient online services for data access. Some may view the hirings as further evidence of a cloud-based iTunes or other MobileMe-style services from Apple,...

iPhone 4 makes eBay's 'Top Shopped' List
eBay has announced its annual “Top Shopped” report, revealing the top pop culture moments and fashion trends that captivated shoppers’ curiosity -- and cash -- in 2010. Apple's iPhone 4 topped the list. eBay analyzed sales and search data across categories in the marketplace to identify the year’s major moments and movements, says Karen Bard Sayah, eBay’s trend expert. From tech and toys to sports memorabilia and fashion, eBay tracked trends that turned the ordinary into prized possessions, she adds. eBay's picks for America's "Top Shopped" and pop culture obsessions for 2010 are: the iPhone 4, Barbie, military jackets, Hot Wheels, the iPad, World Cup, The Beatles, Silly Bandz, Alice in Wonderland, New Orleans Saints, Marc Jacobs and LeBron James. One company produced two of the year’s most coveted new devices: Apple’s iPhone 4 (1,634,674 related items sold) and iPad (621,399 related items sold). Apple’s flagship products conquered the tech scene as well as pop culture and were...

Analyst: iPad, other Apple goodies in hot demand for the...
Wedge Partners analyst Brian Blair said recent retail checks point to significant end demand for the iPad (and other Apple products) reports "All Things D" (http://macte.ch/APDJ1). “Even with a handful of tablet competitors hitting the market, the iPad remained the only game in town in our holiday checks largely because many of the tablets hitting the market are junk for lack of a better word,” he told clients. “They are underpowered, poorly constructed and largely not ready for prime time.” The holiday season is always particularly kind to Apple, but this year it may have been even kinder than usual, notes "All Things D." In addition to the iPad’s continued momentum at market, Blair observed stronger than expected holiday sales of iMacs, MacBook Pros and the new 11-inch MacBook Air.

Apple sued for transmitting personal data to ad networks
Another day, another lawsuit. A lawsuit accuses Apple of enabling some of its products to transmit users' personal data to advertising networks without the users' permission, "Bloomberg News" (http://macte.ch/7twJw) reports. The lawsuit was filed Dec. 23 in federal court in San Jose, California, on behalf of Jonathan Lalo of Los Angeles County, and seeks class-action status. The suit says iPhones and iPads are encoded with identifying devices that allow advertising networks to track what applications users download, how frequently they’re used and for how long. The transmission of such data violates computer-fraud and privacy laws. iPhones and iPads are set with a Unique Device Identifier, or UDID, which can’t be blocked by users, according to the complaint. "Bloomberg News" notes that Apple says it reviews all applications on its App Store and doesn’t allow them to transmit user data without customer permission, according to the complaint. "Bloomberg News" says the lawsuit...

Analyst: next iPad will be dual-core
The next iPad will adopt a dual-core chip, which would be a first for the company's consumer line of handheld products, Ashok Kumar, an analyst at Rodman & Renshaw, told clients in a note -- as reported by "CNET" (http://macte.ch/eczVy). "Apple is on track to refresh the iPad by March and iPhone by late summer," he says. "A key component upgrade across these platforms will be a dual-core processor featuring a pair of 1GHz ARM Cortex A9 cores." Using a dual-core processor can result in computer-like multitasking, if the operating system is designed to fully take advantage of both cores, notes "CNET." Kumar also expects the iPhone to get a dual-core upgrade.

'DigiTimes': Three versions of the iPad 2 are in the...
Apple will release three versions of the "iPad 2," supporting either or a combination of Wi-Fi, UMTS and CDMA, for 2011 with mass production to start as early as the later half of January, according to a "DigiTimes" report (http://macte.ch/fzX2z). Apple will ship about 500,000-530,000 units to channels in January with shipment ratio of Wi-Fi, UMTS and CDMA models at 3:4:3, the article says, quoting "industry sources" and "upstream component makers." Apparently, Apple plans to work more closely with telecom carriers by offering more wireless solutions for iPad 2 to satisfy market demand. In addition to wireless functions, Apple is also working on strengthening the iPad 2's anti-smudge and anti-reflective treatments in order to compete against Kindle and attract more consumers, the sources noted. As for iPad 2, "DigiTimes" estimates that the device's shipments in 2011 will reach 40 million units, accounting for 65-75% of the global tablet market.

iPad, tablets put the squeeze on netbook prices
Strong tablet computer demand for gadgets such as the iPad continues to impact netbook market and several brand vendors in Taiwan have dropped their netbook price further to attract consumers, according to "DigiTimes" (http://macte.ch/QB21H). Quoting sources from channel vendors, the article says the current channel demand for netbooks is very low and the only advantages that the devices have now are low-price and capability of bundling with telecom carriers. However, since telecom carriers are turning their focus to smartphones and tablet computers, netbook shipments in 2011 are expected to see an obvious drop. On the other hand, tablet PC shipments are expected to reach more than 20 million units in 2010 and over 40 million units in 2011, notes "DigiTimes."

McAfee Labs: Apple, geolocation, mobile devices to top emerging...
McAfee (http://www.mcafee.com) has unveiled its "2011 Threat Predictions" report, outlining the top threats that researchers at McAfee Labs foresee for the coming year. The list comprises 2010’s most buzzed about platforms and services, including the iPhone, Mac OS X, Google’s Android, foursquare, and Google TV. Per the report, all are expected to become major targets for cybercriminals. McAfee Labs also predicts that politically motivated attacks will be on the rise, as more groups are expected to repeat the WikiLeaks paradigm. “We’ve seen significant advancements in device and social network adoption, placing a bulls-eye on the platforms and services users are embracing the most,” says Vincent Weafer, senior vice president of McAfee Labs. “These platforms and services have become very popular in a short amount of time, and we’re already seeing a significant increase in vulnerabilities, attacks and data loss.” Historically, the Mac OS platform has remained relatively unscathed by...
