'Gizmodo' not charged in lost iPhone 4 prototype case
The San Mateo County (California) district attorney's office has filed misdemeanor charges against two people involved in finding and selling an Apple iPhone 4 prototype to "Gizmodo," but has decided not to bring charges against any employees of Gizmodo or its parent company, Gawker Media, according to "AppleInsider" (http://www.appleinsider.com). In March 2010, an Apple employee lost contact with a prototype of an upcoming iPhone. He either lost it or it was stolen while he was visiting a bar in Redwood City, California. The device was obtained by Brian Hogan who then sold the phone to "Gizmodo." Police served a subpoena at editor Jason Chen's home in Fremont, California. Attorneys representing Chen and Gawker Media, the parent company of "Gizmodo," claimed the search warrant used to seize Chen's property was "invalid," citing a California law curbing newsroom searches. "Gizmodo" says the district attorney "has decided, upon review of all of the evidence, that no crime was committed...

Vudu comes to the iPad
Vudu is making itself available on the iPad, a move that will help the streaming-video service expand distribution and keep pace with market leader Netflix, reports "CNET" (http://macte.ch/cjPaN). Vudu said in a joint statement with parent company Wal-Mart Stores that iPad owners can access Vudu through their browsers. Through the new feature, iPad owners can rent or purchase one of Vudu's 20,000 movies and TV shows. Renting or purchasing Vudu's videos via the iPad works the same as it does on a computer and the prices are the same. One problem with Vudu, as with Netflix and all streaming-video services, is that you can't watch if you can't connect to the Web, notes "CNET." Another issue is that Vudu hasn't secured licenses to offer Disney films on the iPad.

OS X passes Linux as development environment in North America
Mac OS X has surpassed Linux in popularity as a development environment in North America according to the recently released Evans Data North American Development survey (http://www.evansdata.com). Although Windows remains overwhelmingly the most popular operating system for development with over 80% of developers using it, Linux has slipped to third place with only 5.6% using it as their primary development platform, while 7.9% now use Mac OS X. "Apple has made tremendous strides in the last few years with innovative products and technologies, so it’s quite reasonable to see developers adopting the Mac and its OS as a development environment," says Janel Garvin, CEO of Evans Data Corp. "Windows firmly remains king, but developers are obviously attracted to Apple’s devices, while at the same time Linux has lost some of its luster after years of only single digit adoption." However, Mac OS hasn't displaced Linux as a development target. Still more than twice as many developers primarily...

Analyst: Apple shares still a 'compelling' buy
In a note to clients -- as reported by "CNN Money" (http://macte.ch/RI3iM) -- Sterne Agee analyst Shaw Wu says Apple shares are still a "compelling buy" for several reasons: ° The company still has only 4%-5% share in mobile phones and 4%-5% in computers (12%-13% including the iPad) so has the opportunity to double or potentially even triple its market share in these end markets over the next few years, particularly with Greater China and international as "underpenetrated opportunities." ° Apple is one of the best ways -- if not the best way -- to play what he sees as three "mega trends": 1) the mobile Internet, 2) cloud computing, and 3) consumerization of technology. ° Apple has a strong product release schedule going into the holiday season, including iOS 5, iCloud and a new iPhone on top of the recent release of OS X 10.7 ("Lion") and three new Macs (the MacBook Air, MacBook Pro, Mac Mini).

Apple is (briefly) US's most valuable company
For a brief moment yesterday, Apple bumped Exxon Mobil into the runner-up spot on the New York Stock Exchange to become the most valuable company in the US. However, the oil giant was restored to the top of the pile at close of trading on Tuesday. Apple's brief perch at the top was considered significant by market analysts, who suggested that it was the iPad and iPhone maker's destiny to eventually take a more permanent seat in at the top of the heap, reports "The Register" (http://macte.ch/grlJa). Apple's value climbed to US$341.5b billion yesterday afternoon, just ahead of Exxon Mobil's $341.4 billion trading figure.

Apple suing Motorola in Europe over Xoom design
Another day, another lawsuit. Apple is also suing Motorola in Europe over the Xoom tablet's design, reports "FOSS Patents" (http://macte.ch/4yTnD). Prior to or simultaneously with the motion for a preliminary injunction against Samsung over its Galaxy Tab design, Apple also filed a complaint with the same court over the design of the Xoom, the article notes. That passage says that Apple filed with the same court (district court of Düsseldorf) a complaint over the design of the Motorola Xoom, but it doesn't state whether that complaint included a request for a preliminary injunction. "While it's not stated explicitly, I suppose that the complaint against Motorola also asks the court for an EU-wide injunction -- but perhaps just for a permanent injunction without a previous preliminary one," says Florian Mueller, writing for "FOSS Patents."

Apple taking extra Apple ID security steps
Apple has begun sending emails when Apple ID's are used to make purchases on iOS devices not previously associated with the account. It's "likely these emails are being used as one way to combat increasingly frequent app purchase fraud," says "MacRumors" (http://www.macrumors.com). Apple already requires credit card users to reenter the three or four digit CID number from the back of their credit card (front in the case of American Express) to authenticate the new device. However users with balances from iTunes Store Gift Cards aren't required to perform any special authentication other than entering their AppleID password.

Hagens Berman files class action lawsuit against Apple,...
Another day, another lawsuit. Hagens Berman, a consumer rights class-action law firm, has filed a nationwide class-action lawsuit claiming that Apple Inc., and five of the nation’s top publishers -- including HarperCollins Publishers ( a subsidiary of News Corp.) Hachette Book Group, Macmillan Publishers, Penguin Group (a subsidiary of Pearson PLC), and Simon & Schuster (a subsidiary of CBS) -- illegally fix prices of electronic books, also known as e-books. Filed in the U.S. District Court for the Northern District of California, the lawsuit alleges that the publishers and Apple colluded to increase prices for popular e-book titles to boost profits and force e-book rival Amazon to abandon its pro-consumer discount pricing. According to the suit, publishers believed that Amazon’s wildly popular Kindle e-reader device and the company’s discounted pricing for e-books would increase the adoption of e-books, and feared Amazon’s discounted pricing structure would permanently set...

Samsung Galaxy Tab 10.1 Just Banned in Europe
Posted by Greg Mills Apple has Just obtained an injunction banning sales and marketing of the Samsung Galaxy Tab 10.1 tablet in Europe. Apple has sued Samsung and other Android handset makers for patent infringement around the world. Australia banned the Galaxy Tab last week and now Europe, except the Netherlands has also banned the sale and marketing of the Samsung device just a couple of weeks from its launch. This bodes badly for the Android platform and adds an international confirmation to the initial finding of the US International Trade Commission. Should the Galaxy Tab be banned in all the major markets, Samsung will be stuck with very cool tablets with no place to sell them. Apple's legal actions are beginning to have a powerful effect just before the rumored iPhone 5 and iPad 3 launch possibly coming early this fall. That a major electronics firm like Samsung could get stung with an international import ban bodes badly for the entire Android platform. See: http://www....

Gartner: Mac to have 5.2% of global computer market by 2015
Windows 7 will become the leading operating system worldwide in the personal computer installed base, running on 42% of computers in use by the end of 2011, according to the Gartner research group (http://www.gartner.com). However, the Mac also continues to make big strides. Shipments of Macs have seen increases in the last 12 months. Mac OS X was shipped on 4% of new computers worldwide in 2010 versus 3.3% in 2008. Mac OS X is forecast to be on 4.5% of computers in 2011, and grow to 5.2% of new computers in 2015. Shipments will grow stronger in mature markets where consumers are buying into the Apple product ecosystem. "The adoption of Mac PCs and Mac OS is a result of Apple's ability to grow well above the market average in the last 12 to 24 months, thanks to its ease of use from the user interface (UI) point of view and ease of integration with other Apple devices, such as the iPhone, iPad, iPod touch and the existing Apple ecosystem of applications and programs," says Annette...

ITC to review Apple's infringement suit against HTC
Apple's patent infringement suit against HTC Corp. will be reviewed by a U.S. trade agency that has the power to block imports of the Taiwanese company’s phones and new tablet computers, reports "Bloomberg" (http://macte.ch/RpcTL). The International Trade Commission (ITC) said it will investigate Apple’s accusations that HTC infringed five patents related to software architecture and user interfaces in portable electronic devices, hardware for touch screens and movement sensors. Notice of the decision was posted on the agency’s website today. Last month HTC sued Apple in the UK. The complaint, filed in London, came two weeks after HTC lost a ruling against Apple at the ITC. The agency ruled on July 15 that HTC’s Android-based mobile phones infringe two Apple patents, a judgment that HTC has said it will appeal. However, HTC has said it's willing to negotiate with Apple after both sides scored earlier victories at the ITC. On July 6 HTC announced an US$300 million deal to buy S3...

Apple planning to help iOS developers take on Lodsys
Apple is still planning on helping its iOS developers take on Lodsys in an ongoing legal battle, reports "FOSS Patents" (http://macte.ch/OIHnC). "Apple still requests a court hearing on its motion," writes Florian Mueller for the site. "Things may still take some more time, but there will be no more written pleadings unless the court asks the parties to address particular questions in more detail. At this stage it's possible that the court decides very quickly, and I continue to be reasonably optimistic that Apple's motion will be granted." In May Apple's legal department came to the defense of iOS app developers with a letter to Lodsys regarding its patent dispute with app developers. In the letter to Lodsys, Bruce Sewell, Apple senior vice president and general counsel said, Apple is undisputedly licensed to these patents and the App Makers are protected by that license. "Thus the technology that is targeted in your notice letters is technology that Apple is expressly licensed under...

Seagate (http://www.seagate.com) has unveiled the GoFlex Turbo performance drive with SafetyNet data recovery services (DRS). The company says that SafetyNet data recovery is the first recovery service offering by a hard drive manufacturer to be included as part of the purchase price of an external drive. With the latest super speed USB 3.0 interface and RPMs clocked at 7200, the GoFlex Turbo drive is equipped to handle transfer speeds up to 40% faster than that of its USB 2.0, 5400-RPM siblings. Alas, the Mac doesn't support USB 3.0, so drives with this interface will run at USB 2.0 speeds. The new GoFlex Turbo performance drive features two-years of SafetyNet data recovery services. It's available from Best Buy for a manufacturer’s suggested retail price of US$119.99 for 500GB models and $139.99 for 750GB versions.

QNAP NAS management software roars onto Lion
QNAP Systems (http://www.qnap.com) has announced new 3.5 NAS management software for its Turbo NAS series, embedded as firmware. It's compatible with Mac OS X 10.7 ("Lion"), provides LDAP, antivirus, syslog server support, and more. Firmware 3.5 also includes a service binding feature and enhanced MyCloudNAS services. Firmware 3.5 provides several new security enhancements. New antivirus feature allows the administrator to scan the NAS manually or on a recurring schedule; then delete or quarantine files infected by viruses, malware, trojans, and other malicious threats. A new Radius server provides Raidius client-enabled devices with centralized account management and authentication for network access. External drive encryption blocks unauthorized access and protects data on external drives from theft by encrypting a disk volume or a specific partition. The 3.5 firmware will be available for a variety of QNAP Turbo NAS models by mid-August.

Apple hires laid-off Cisco engineers
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Global Equities Research analyst Trip Chowdhry says Apple has hired 20 to 25 of the engineers Cisco recently laid off. The analyst says Aruba, HP and Huawei are putting intense competitive pressure on Cisco and Juniper by offering much cheaper pricing on their own networking gear and adding in free support, services and lifetime warranties. Additionally, the overall market for network switches supporting Cisco and Juniper sales is also being targeted by the release of VMware VSphere 5.0, which delivers a new usability in network virtualization that is "starting to disrupt" sales of physical switches, Chowdhry adds. Apple "has been working hard to hire qualified candidates in a highly competitive business climate where companies like Dropbox, Facebook, Google, OpenX and Twitter are all growing dramatically and also in need of engineers," says "AppleInsider."

ClickFox: iPhone users need less support than Android,...
A note to those in iT: iPhones require less support than Androids and BlackBerrys, according to ClickFox (http://www.clickfox.com), a company that analyzes customer experience data to identify problems. ClickFox analyzed the support calls related to smartphones received by the North American carriers, and after factoring out the questions related to billing and carriers' various plans, it found that iPhones cost less to support than Android devices and BlackBerrys, according to "Infoworld" (http://macte.ch/ELLEq). ClickFox analytics director Lauren Smith told "InfoWorld" that BlackBerry users cost North American carriers in aggregate US$46 million more a year to support than iPhone users, and Android users costing $97 million more a year. Why? It more often takes multiple agents to solve a BlackBerry or Android user's problem, which means calls must be transferred, or the issue ends up taking multiple discussions to resolve. By contrast, iPhone users' problems are typically handled...

Analyst: Mac, iPad to make significant gains in second half of...
In a note to clients -- as reported by "AppleInsider" (http://www.appleinsider.com) -- Deutsche Bank analyst Chris Whitmore says that the Mac and iPad lineup are set to make significant gains in the second half of 2011, as the Windows-based PC market remains "relatively stagnant." He thinks the traditional PC market lacks "meaningful new offerings" coming this year, while Apple is aggressive with both new hardware and software. Whitmore cites the recent launch of OS X 10.7 Lion, as well as Thunderbolt-equipped MacBook Airs, as key products in driving Apple's market share gains. While the Mac alone is predicted to earn market share gains at the expense of Windows-based PCs, factoring in the iPad makes Apple's growth even greater, notes "AppleInsider." Whitmore said the Apple tablet will continue to dominate for the foreseeable future.

Apple introduces $999 education iMac
Apple has introduced an US$999 21.5-inch iMac for authorized education purchasers. It's not available at the online education store -- at least not yet. The education only model is less expensive than the $1,200, 21.5-inch iMac offered to all consumers. For example, it only comes with 2GB of memory (compared to a 4GB minimum for all other shipping Macs). However, the memory can be upgraded to 8GM. The education iMac has a 250GB (7200 RPM) hard drive and an AMD Radeon HD 6750M graphics processor with 256MB of GDDR5 memory. This compares to a 500GB hard drive and a AMD Radeon HD 6750M graphics processor with 512MB of GDDR5 memory on the $1,200 model. As for processing power, the education iMac sports a a 3.1GHz Intel Core i3 dual-core processor compared to a 2.6GHz quad-core Intel processor o the $1,200 model. It also lacks a Thunderbolt port.

'iTunes Replay' still a ways off?
Rumors of Apple enabling iTunes users to stream movies from Apple's servers and then re-download them to other devices, probably as part of the upcoming iCloud service, "are at best premature," according to "CNET" (http://macte.ch/OxJ3o). Apple has yet to sign cloud agreements for feature films with at least four of the top six film studios, according to multiple film industry sources who spoke to "CNET." Apple has indeed pursued such agreements, which CNET reported in May, but Apple's negotiations could drag on for months before the company acquires cloud rights from all six film studios, the sources said. A launch isn't imminent, says "CNET. The long-rumored iTunes Replay would purportedly allow iTunes shoppers to build out their digital video collection without worrying about the space needed to store the often hefty media files. By storing their video content for them and allowing users to stream it for viewing as often as they want, Apple would essentially be offering a media...
